Sense Terms of Service

Welcome to Sense (“Sense,” “we,” “us,” or “our”), a service operated at sensing.app that enables users to perform and benefit from a wide range of Knowledge Work—including collecting, extracting, synthesizing, analyzing, and interpreting information to generate insights, intelligence, briefings, and other deliverables. These Terms of Service (“Terms”) govern your access to and use of Sense, including any related applications, websites, and services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.

Contents

1. Definitions

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features, you may be required to create an account. You agree to:

We reserve the right to suspend or terminate accounts for breach of these Terms or suspicious activity.

4. Service Description

Sense enables you to perform and benefit from various forms of Knowledge Work by:

5. Ownership & License

5.1 Output Ownership

Subject to your compliance with these Terms and any applicable payment, you receive a perpetual, worldwide, royalty-free, non-exclusive license to the Outputs—meaning you may use, reproduce, distribute, display, and otherwise exploit the final Output content for any lawful purpose. This license reflects that you control the final product of the Knowledge Work; it does not convey ownership of the underlying models, algorithms, infrastructure, or proprietary mechanisms used to produce the Outputs.

5.2 User Input

You retain all ownership rights in the User Input you submit. By submitting User Input, you grant Sense a non-exclusive, worldwide, royalty-free, sublicenseable, and transferable license to use, process, analyze, and incorporate such input for the purpose of delivering and improving the Service, including in aggregated or anonymized form.

5.3 Third-Party Data

Sense may collect or surface publicly available Third-Party Data at your direction (e.g., from public websites, social platforms, news sources, or other publicly accessible resources). You acknowledge and agree that:

5.4 Feedback & Improvements

If you provide suggestions, feedback, or ideas about the Service (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such Feedback without obligation to you.

6. Subscription, Payment, and Renewal

If the Service is offered under a paid plan:

7. Acceptable Use

You agree not to:

8. Intellectual Property Rights

All rights, title, and interest in and to Sense, including its software, infrastructure, trademarks, trade dress, and proprietary technologies, remain with us or our licensors. Except for the licenses expressly granted in Section 5, no other rights are granted.

9. Third-Party Integrations and Data Sources

The Service may integrate with or retrieve data from third-party services or publicly available sources. You agree that:

10. Disclaimer of Warranties

THE SERVICE, THIRD-PARTY DATA, AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUFFICIENT FOR YOUR PURPOSES.

10.1 AI-Generated Content; Accuracy, Citations, and Risk Acknowledgment

Sense makes heavy use of artificial intelligence and automated processes to perform Knowledge Work and generate Outputs. While we have implemented internal safeguards, validation layers, and other processes designed to reduce errors and minimize AI “hallucinations” (instances where the system produces content that may be incorrect, misleading, or not fully supported by source data), you acknowledge and agree to the following:

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, THIRD-PARTY DATA, OR OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PRIOR TWELVE (12) MONTHS, OR, IF YOU HAVE NOT PAID US, ONE HUNDRED DOLLARS (USD $100).

12. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

13. Modifications to the Service or Terms

We may modify, suspend, or discontinue the Service (or any portion thereof) at any time without notice. We may also update these Terms; if we do, we will notify you as appropriate (e.g., via email or in-app notice). Your continued use after the effective date of updates constitutes acceptance of the modified Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, the licenses granted to you in Section 5 with respect to Outputs survive, but your access to the Service may end immediately.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of [INSERT JURISDICTION, e.g., the State of New York], without regard to its conflict of law principles.
Dispute Resolution: [Choose and insert your preferred mechanism—e.g., binding arbitration with carve-outs, or venue specification for courts.]

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with any policies or guidelines referenced herein (including the Privacy Policy), constitute the entire agreement between you and Sense regarding the Service and supersede all prior understandings.

18. User Modifications to Outputs

You are responsible for any modifications you make to Outputs. We are not liable for decisions or actions you take based on customized or edited Outputs.

19. Privacy

Your use of the Service is governed by our Privacy Policy, available at: https://sensing.app/privacy. The Privacy Policy explains what data we collect (including via Google OAuth), how we use it, your rights, and how to contact us about privacy.
If you have users in jurisdictions with special data protection rights (e.g., EU/UK GDPR, California privacy laws), supplemental disclosures or a compliance addendum may apply.

20. Miscellaneous

21. Google OAuth and Authentication

We support login via Google OAuth to simplify account creation and authentication. Only the minimal identity scopes needed (such as email and basic profile) are requested. The information obtained is used to create or link your Sense account, personalize your experience, and communicate service-related messages. You may revoke access at any time via your Google account settings or through Sense’s account management UI. OAuth tokens and identity information are stored securely, transmitted over encrypted channels, and retained only as long as necessary to provide the Service.
